These Terms of Service govern your use of swepton.com and the cleaning

services provided by Swept On Janitorial ("Swept-On," "we," "us," or "our").

By using our website, requesting a quote, or accepting services,

you agree to these Terms.

Terms of Service

These Terms of Service govern your use of swepton.com and the cleaning

services provided by Swept On Janitorial ("Swept-On," "we," "us," or "our").

By using our website, requesting a quote, or accepting services,

you agree to these Terms.

1. Order of Precedence

If you have a signed service agreement, scope of work, task order, purchase order, or government contract with us, that document controls over these Terms to the extent of any conflict. These Terms apply to website use and fill any gaps not addressed by a signed agreement. For federal, state, or local government work, the terms and clauses of the applicable contract or solicitation control in all cases.

2. Eligibility & Authority

You must be at least 18 years old to use our website or engage our services. If you are booking on behalf of a business, agency, property owner, or other entity, you represent that you have authority to bind that entity and to authorize access to the property in question.

3. Use of Website

You agree to use our website only for lawful purposes. You may not attempt to gain unauthorized access to any part of the site, interfere with its operation, scrape or harvest content, submit false information, or use the site in a way that infringes the rights of others.

Website content, including text, graphics, logos, images, and the Swept-On name and marks, is owned by or licensed to us and protected by copyright and trademark law. You may not use our marks without prior written consent.

4. Walkthroughs, Quotes, and Scope of Work

We do not quote services sight unseen. Every bid follows an on-site walkthrough. Walkthroughs are provided at no charge and carry no obligation.

Following the walkthrough, we issue a written scope of work identifying the areas,

tasks, and frequencies included, along with a flat rate for that scope.

Quotes are valid for 30 days from issuance unless stated otherwise.

Work not identified in the written scope is not included in the rate.

If conditions materially differ from what was observed at the walkthrough — including undisclosed damage, hoarding conditions, biohazard, pest infestation, or substantially greater soil load — we will stop, notify you, and provide a revised quote before proceeding.

5. Pricing, Minimums, and Change Orders

Our services are priced at a flat rate for the documented scope, not hourly. The time our crew takes to complete the scope does not change your price.

One-time services begin at $175.

Recurring services begin at $85 per visit.

Add-on services, including carpet extraction, strip and wax, wall washing, odor treatment, and post-event resets, are quoted separately.

Any change to the scope must be agreed in writing before the work is performed. We will not perform out-of-scope work and bill for it afterward, and we are not obligated to perform out-of-scope work requested on site.

We may revise pricing on recurring accounts with 30 days' written notice.

6. Payment Methods and Terms

Accepted payment methods: credit card, debit card, EFT/ACH transfer, corporate check, and wire transfer. We do not accept PayPal or third-party peer-to-peer payment applications.

A deposit is required to secure a booking and is applied to the balance due. The amount is disclosed at booking.

One-time services are payable on completion unless otherwise agreed in writing.

Recurring and contract accounts are invoiced on Net 15 terms unless the signed agreement states otherwise.

Past-due balances accrue interest at 1.5% per month (18% annually) or the maximum permitted by Oklahoma law, whichever is less.

Returned checks and failed ACH transactions are subject to a fee equal to the maximum permitted by Oklahoma law, plus any bank charges we incur.

You are responsible for reasonable costs of collection, including attorney fees, on amounts properly owed and not disputed in good faith.

We may suspend service on accounts more than 30 days past due after written notice.

Card and ACH details are handled by third-party processors. We do not store full payment card numbers or complete bank account credentials.

7. Scheduling, Access, and Key Control

Service begins within 48 hours of a signed scope of work, subject to crew availability and your access schedule.

You are responsible for providing safe, lawful access to the property at the scheduled time, including keys, codes, badges, parking, and any escort your facility requires.

Keys, access codes, and credentials are logged, restricted to assigned personnel, and returned or destroyed at the end of the engagement. Notify us immediately of any credential change.

You are responsible for providing working utilities — electricity, running water, and lighting — at the time of service. If utilities are unavailable, we may be unable to complete the scope and the visit may be billed as a lockout.

Lockouts. If our crew arrives and cannot access the property, cannot begin within 30 minutes of the scheduled time, or is turned away, the visit will be billed at 50% of the service rate to cover crew mobilization.

8. Cancellation and Rescheduling

You may cancel or reschedule with at least 24 hours' notice at no charge.

Cancellations inside 24 hours are billed at 50% of the service rate.

Deposits on services cancelled inside 24 hours may be forfeited.

Recurring agreements may be terminated by either party with 30 days' written notice unless the signed agreement specifies otherwise. Amounts for services already performed remain due.

We reserve the right to decline or discontinue service, including for unsafe conditions, harassment or abuse of our personnel, nonpayment, or misrepresentation of the property or scope.

9. Satisfaction and Corrective Service

If any portion of the work does not meet the documented scope, notify us within 24 hours of service completion and we will return and correct it at no additional charge. This corrective-service commitment is our sole remedy for scope-related service complaints and does not constitute a refund guarantee. Requests made more than 24 hours after completion may be scheduled as a new service.

10. Photo Documentation

We photograph work areas before and after service as a condition of our quality assurance and claims process. By engaging our services you consent to this documentation within the agreed scope areas. We do not use client job photos publicly without your written permission. Photo protocols may be restricted or discontinued at your written request, and are set to your facility's requirements where security or confidentiality restrictions apply. 11. Your Responsibilities

Before service, you agree to:

Secure or remove cash, jewelry, firearms, prescription medication, sensitive documents, and irreplaceable items from the service area

Disclose known hazards, including damaged flooring, faulty fixtures, unstable surfaces, chemical storage, asbestos, lead, or mold

Disclose any surface requiring special handling — natural stone, unsealed wood, antiques, specialty finishes, or manufacturer-restricted materials

Secure pets during service

Identify who is authorized to direct or accept the work on your behalf

12. Service not Included

The following are outside standard scope and are not performed without a separate written agreement and, where applicable, specialized licensing:

Biohazard, bodily fluid, crime scene, or trauma remediation

Mold remediation or abatement

Asbestos or lead abatement

Pest control or extermination

Hoarding conditions without a prior on-site assessment

Structural, electrical, plumbing, or mechanical repair

Moving heavy furniture, appliances, or equipment

Exterior work at heights requiring equipment not specified in the scope

Removal of hazardous waste or materials requiring regulated disposal

We may also decline to clean items or surfaces where doing so risks damage, or where the manufacturer's care requirements conflict with the requested method.

13. Damage, Loss and Claims

Report any alleged damage or loss in writing within 48 hours of the service visit. Claims made after that window cannot be verified against our documentation and may be denied.

We are not responsible for pre-existing damage or for damage arising from conditions not disclosed to us, including worn, previously repaired, improperly installed, or already-failing surfaces and fixtures.

We are not responsible for damage to items you were asked to secure or remove under Section 11.

Verified damage caused by our personnel will be repaired, replaced, or reimbursed at our option, subject to our insurance coverage.

14. Insurance and Bonding

We maintain general liability insurance and workers' compensation coverage, and our personnel are bonded. Certificates of insurance are issued on request and your entity may be named as additional insured where your agreement requires it.

15. Non-Solicitation of Personnel

During the term of service and for twelve months afterward, you agree not to directly or indirectly solicit, hire, or engage any Swept-On employee or subcontractor who performed services at your property, whether as an employee, independent contractor, or through another cleaning company.

We invest substantially in recruiting, screening, and training our personnel. If you hire one of them in breach of this section, you agree to pay a placement fee of $2,500 as liquidated damages, which the parties agree is a reasonable estimate of our loss and not a penalty.

16. Supplies, Equipment, and Personnel

Unless the scope states otherwise, we provide all cleaning supplies, equipment, and consumables. If you require specific products, provide them or specify them in the scope; we are not responsible for results or damage arising from client-supplied products or from methods you direct us to use against our recommendation.

Our personnel are our employees or subcontractors. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and any Swept-On personnel. We retain sole authority over hiring, supervision, scheduling, and assignment of our crews.

17. Force Majeure

Neither party is liable for delay or failure to perform caused by events beyond reasonable control, including severe weather, natural disaster, fire, utility failure, labor disruption, public health emergency, government action, or building closure. We will make reasonable efforts to reschedule affected service.

18. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or relating to these Terms or our services is limited to the amount you paid us for the specific service giving rise to the claim, or $1,000, whichever is greater. This limitation does not apply to claims covered by our general liability insurance, to bodily injury caused by our negligence, or to any liability that cannot be limited under applicable law.

Neither party is liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost rent, or business interruption, even if advised of the possibility. Some states do not permit these limitations, in which case they apply to the greatest extent allowed.

Our website is provided "as is" without warranty of any kind as to accuracy, availability, or freedom from error.

19. Indemnification

You agree to indemnify and hold harmless Swept-On, its officers, employees, and subcontractors from claims, damages, and reasonable costs arising from your breach of these Terms, your failure to disclose hazards or restricted surfaces, your failure to secure the property or items under Section 11, or your violation of law. This does not extend to claims arising from our own negligence or willful misconduct.

20. Dispute Resolution and Governing Law

Before filing any action, the parties agree to attempt in good faith to resolve the dispute by contacting each other directly and conferring within 30 days.

These Terms are governed by the laws of the State of Oklahoma without regard to conflict of law principles. Any action arising from these Terms or our services shall be brought exclusively in the state or federal courts located in Oklahoma County, Oklahoma, and the parties consent to that jurisdiction and venue. This section does not apply to disputes arising under a federal government contract, which are governed by the Contract Disputes Act and the terms of the applicable contract.

21. General

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with any signed agreement and our Privacy Policy, constitute the entire agreement regarding your use of our website and services.

22. Changes to These Terms

We may modify these Terms at any time by posting a revised version on this page and updating the "Last Updated" date. Material changes affecting existing service agreements will be communicated with at least 30 days' notice. Continued use of our website or services after the effective date constitutes acceptance.
